Terms of Service

Welcome to Khandaani ("the App"). These Terms of Service ("Terms") govern your use of the App and its services. As used in this Agreement, the terms “Khandaani,” “Khandaani Limited,” “us,” “we,” the “Company”, and “our” shall refer to Khandaani Ltd. By using the App, you agree to these Terms. If you do not agree with any part of these Terms, you must not use the App.

 

1. Introduction 

 

1.1. By accessing or using our Services on www.khandaani.app (the “Website”), the Khandaani mobile application (the “App”), or any other platforms or services Khandaani may offer (collectively, the "Service" or our "Services"), you agree to, and are bound by this Agreement. This Agreement applies to anyone who accesses or uses our Services, regardless of registration or subscription status. 

 

1.2. Your access and use of our Services are also subject to our Privacy Policy, Cookies Policy, and any terms disclosed and agreed to by you when you purchase additional features, products, or services from Khandaani ("Additional Terms Upon Purchase").

 

2. Eligibility 

 

2.1. You must be at least 18 years old to use the App. 

 

2.2. By using the App, you represent and warrant that:

 

• You are legally qualified to enter a binding contract with Khandaani.

• You are seeking a meaningful relationship.

• You are not prohibited by law from using our services.

• You have not been convicted of or pled no contest to a felony or indictable offense, a sex crime, or any crime involving violence or a threat of violence.

• You are not required to register as a sex offender with any state, federal, or local sex offender registry.

• You do not have more than one account on our Services.

• You have not previously been removed from our Services or our affiliates’ services by us or our affiliates, unless you have our express written permission to create a new account.

 

3. Account Registration 

 

3.1. To use the App, you must create an account and provide accurate, current, and complete information. 

 

3.2. You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities that occur under your account. 

 

3.3. You agree to notify us immediately of any unauthorized use of your account.

 

4. User Conduct 

 

4.1. You agree to use the App in accordance with all applicable laws and regulations. 

 

4.2. You must not:

 

• Misrepresent your identity, age, current or previous positions, qualifications, or affiliations with a person or entity.

• Use the App for any commercial purposes without our express written consent.

• Harass, threaten, or intimidate other users.

• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

• Post or share Prohibited Content (defined below).

 

5. Content 

 

5.1. You retain all ownership rights to the content you post on the App ("Your Content"). 

 

5.2. By posting content on the App, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such content. 

 

5.3. We reserve the right to monitor, review, remove, delete, edit, limit, or block access to any content at our sole discretion and without notice. 

 

5.4. You are solely responsible for the content you post and for ensuring its accuracy and legality.

 

6. Inappropriate Content and Misconduct 

 

6.1. Khandaani does not tolerate inappropriate content or behavior on our Services. 

 

6.2. We encourage you to report any inappropriate Member Content or misconduct by other users. You can report a user directly through the App.

 

7. Privacy 

 

7.1. Your privacy is important to us. Please review our Privacy Policy, which governs the processing of any personal data collected from you.

 

8. Subscription and Payments 

 

8.1. Some features of the App may require a subscription or payment. If you choose to subscribe, you agree to pay all fees and charges associated with your account on a timely basis. 

 

8.2. Subscriptions will automatically renew until you cancel them. You can manage or cancel your subscription in your account settings. 

 

8.3. We may change the subscription fees and charges at any time. We will notify you of any changes in advance. 

 

8.4. California subscribers: You may cancel your subscription, without penalty or obligation, at any time prior to midnight of the third business day following the date you subscribed. If you subscribed using an External Service (e.g., Apple ID, Google Play), you must cancel through your External Service.

 

9. Termination 

 

9.1. We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the App or us. 

 

9.2. You may terminate your account at any time by contacting us through the App or via email.

 

10. Disclaimer of Warranties 

 

10.1. The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App, including but not limited to its availability, reliability, or accuracy. 

 

10.2. We do not warrant that the App will be uninterrupted or error-free.

 

11. Limitation of Liability 

 

11.1. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

 

• Your use of the App;

• Any unauthorized access to or use of our servers and/or any personal information stored therein;

• Any interruption or cessation of transmission to or from the App;

• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party;

• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.

 

12. Indemnity 

 

12.1. You agree to indemnify, defend, and hold harmless Khandaani Ltd, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the App or your breach of these Terms.

 

13. Governing Law 

 

13.1. These Terms shall be governed by and construed in accordance with the laws of United Kingdom, without regard to its conflict of law principles. 

 

13.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of United Kingdom.

 

14. Changes to the Terms 

 

14.1. We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on the App. You are advised to review these Terms periodically for any changes. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

16. User Content and Interaction 

 

16.1. You are solely responsible for your interactions with other users. We do not conduct criminal background checks or screenings on our users. 

 

16.2. We do not endorse or verify the background or statements of any user. Use your best judgment when interacting with others.

 

17. Reporting Violations 

 

17.1. You may report any abuse, misuse, or suspicious behaviour to us. We encourage you to report any violations of these Terms or suspicious activity to contact@khandaani.app.

 

18. Intellectual Property Rights 

 

18.1. All intellectual property rights in the App, including but not limited to software, trademarks, design, and content, are owned by or licensed to Khandaani Ltd. 

 

18.2. You may not use, copy, modify, or distribute any content from the App without our express written permission.

 

19. Third-Party Links 

 

19.1. The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. 

 

19.2. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

 

20. Advertisements 

 

20.1. The App may include advertisements, which may be targeted based on the information you provide, the content you access, or other information. 

 

20.2. You agree that we may place such advertising and promotions on the App or on, about, or in conjunction with your content.

 

21. Data Retention 

 

21.1. We will retain your personal information for as long as necessary to provide you with our services and as described in our Privacy Policy. When we no longer need your information, we will securely delete or anonymize it.

 

22. Dispute Resolution 

 

22.1. If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally.

 

23. Miscellaneous 

 

23.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable. 

 

23.2. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. 

 

23.3. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. 

 

23.4. We may assign our rights and obligations under these Terms at any time without notice.

 

By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
